- Acceptance of Terms
These Terms and Conditions ('Terms') govern your access to and use of florabamastore.com and any
purchase made through the Flora-Bama Store. By visiting the website, creating an account, placing an
order, participating in a promotion, submitting content, or otherwise using the website, you agree to
these Terms.
If you do not agree to these Terms, you should not use the website or purchase products from the
Flora-Bama Store. - 2. Website Use
• Use the website only for lawful purposes and in accordance with these Terms.
• Provide accurate and current information when placing orders or creating accounts.
• Do not interfere with website functionality, security, checkout, payment processing, or other users.
• Do not use bots, scrapers, crawlers, or automated tools without written permission.
• Do not attempt to reverse engineer, copy, misuse, or exploit website content, software, or systems.
3. Customer Accounts
You may be able to create a customer account to view order history, manage addresses, or support
checkout. You are responsible for keeping account credentials confidential and for all activity under
your account. We may suspend or terminate accounts if we suspect fraud, misuse, security risk, or
violation of these Terms.
4. Products, Descriptions, and Availability
Flora-Bama Store sells apparel, accessories, drinkware, gifts, event merchandise, limited-edition
products, and other branded merchandise. We try to present products accurately, but colors, sizing,
images, descriptions, and availability may vary by device, vendor, production run, or inventory status.
Product availability is not guaranteed. We may limit quantities, discontinue products, substitute
packaging, correct descriptions, remove items, or cancel orders at any time, including after an order
confirmation is sent.
5. Limited-Edition Merchandise
Certain products may be limited-edition, seasonal, event-specific, collaboration-based, or offered only
while supplies last. Limited-edition status does not guarantee future availability, restocks, resale value,
or exclusivity. We may decide whether to restock, retire, reproduce, or modify any product or design at
our discretion unless otherwise stated in specific promotional terms.
6. Pricing, Promotions, and Errors
Prices are listed in U.S. Dollars and may change without notice. Promotions, discounts, coupon codes,
free shipping offers, bundles, and sale pricing may be subject to additional restrictions, expiration dates,
exclusions, or quantity limits. We reserve the right to correct pricing, typographical, inventory,
promotional, shipping, or checkout errors. If an error affects an order, we may contact you for
instructions, cancel the order, refund the affected amount, or otherwise correct the issue as permitted
by law.
7. Orders and Order Acceptance
After placing an order, you may receive an order confirmation. An order confirmation means we
received your order; it does not guarantee acceptance, fulfillment, or shipment. We reserve the right to
accept, reject, cancel, limit, or modify any order for reasons including inventory shortages, pricing
errors, payment issues, suspected fraud, shipping restrictions, or violation of these Terms.
8. Payment Processing
Payments are processed through Shopify-supported payment providers and other approved
processors. By submitting payment information, you represent that you are authorized to use the
selected payment method. We do not intentionally store full payment card numbers on our own servers.
Payment authorization, settlement, refunds, chargebacks, and related disputes may be handled by the
payment provider according to its terms.
9. Fraud Prevention and Chargebacks
We may use fraud-prevention tools, manual review, address verification, payment verification, and
other safeguards to protect customers and the business. We may cancel or delay orders suspected of
fraud, unauthorized activity, reseller abuse, promotion abuse, or other suspicious conduct. If a
chargeback is filed, we may provide order, shipping, communication, and account records to the
payment provider or card network.
10. Shipping and Delivery
Shipping options, costs, and timelines are displayed at checkout or in our Shipping Policy where
applicable. Delivery dates are estimates only and are not guaranteed. Flora-Bama is not responsible for
delays caused by carriers, weather, holidays, customs, incorrect addresses, high-volume periods,
supply chain issues, or circumstances outside our reasonable control. Risk of loss may transfer when
the product is delivered to the carrier or customer, depending on applicable law and shipping terms.
Customers are responsible for providing accurate shipping information and promptly contacting us if an
address correction is needed.
11. Returns, Exchanges, and Refunds
Returns, exchanges, and refunds are governed by our published Refund Policy and any product-
specific rules. Items may need to be unused, unworn, unwashed, in original condition, with tags or
packaging, and returned within the stated return window. Final sale, customized, event-specific, limited-
edition, clearance, or hygiene-sensitive items may be excluded where permitted by law.
12. Gift Cards
If Flora-Bama Store offers gift cards, they may be subject to additional terms shown at purchase or
delivery. Gift cards are not redeemable for cash except where required by law. Gift cards should be
treated like cash; we are not responsible for lost, stolen, destroyed, or unauthorized use of gift cards
unless required by law.
13. Promotional Campaigns, Sweepstakes, and Giveaways
Promotions, sweepstakes, contests, giveaways, and special offers may be subject to separate official
rules. If separate rules conflict with these Terms, the separate promotion rules will control for that
promotion. Promotions may be modified, suspended, or cancelled if fraud, technical failures, legal
issues, or other circumstances affect the integrity or operation of the promotion.
14. User Reviews, Photos, and Other Content
You may have the opportunity to submit reviews, comments, photos, videos, testimonials, social media
content, or other materials ('User Content'). You represent that you own or have permission to submit
User Content and that it does not violate the rights of others, including copyright, trademark, privacy,
publicity, or other legal rights.
15. Photography and Social Media Rights
By submitting User Content directly to us, tagging Flora-Bama, responding to a permission request,
using a campaign hashtag where permission language is provided, or otherwise granting permission,
you give Flora-Bama a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce,
display, distribute, edit, adapt, and create derivative works from the User Content for marketing,
advertising, ecommerce, social media, website, email, retail, public relations, and other business
purposes.
You understand that User Content may be displayed publicly and may be associated with your name,
handle, likeness, caption, or location if included in the original submission or permission. You waive any
claim to compensation for permitted use unless otherwise agreed in writing.
16. Intellectual Property
The website and its content, including text, product designs, artwork, graphics, photographs, videos,
page layouts, icons, logos, trademarks, trade dress, and software, are owned by Flora-Bama, its
affiliates, licensors, vendors, or content providers and are protected by copyright, trademark, trade
dress, and other intellectual property laws.
17. Trademark Protections
Flora-Bama names, logos, slogans, product marks, event names, and related brand elements are
valuable trademarks or trade dress owned by or licensed to Flora-Bama. You may not use Flora-Bama
marks in a way that suggests sponsorship, affiliation, endorsement, resale authorization, or commercial
association without written permission.
18. Copyright and DMCA-Style Requests
If you believe content on the website infringes your copyright, please contact us with sufficient
information to identify the copyrighted work, the allegedly infringing material, your contact information, a
statement of good-faith belief, and a statement that the information is accurate. We may remove or
disable access to content as appropriate and may terminate repeat infringers where applicable.
19. Prohibited Resale and Commercial Use
Unless expressly authorized, products are sold for personal use and gifting, not for unauthorized
commercial resale, marketplace arbitrage, counterfeit production, or brand exploitation. We may limit or
cancel orders that appear intended for unauthorized resale, bulk purchasing, automated purchasing, or
other activity inconsistent with customer use.

22. Warranty Disclaimer

and 'as available' without warranties of any kind, express or implied, including implied warranties of
merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation,
accuracy, or error-free performance.
23. Limitation of Liability
To the fullest extent permitted by law, Flora-Bama and its owners, officers, employees, affiliates,
vendors, service providers, and licensors will not be liable for indirect, incidental, consequential,
special, exemplary, or punitive damages, lost profits, lost revenue, loss of data, business interruption,
or reputational harm arising from or related to the website, products, orders, promotions, shipping,
returns, or these Terms. To the fullest extent permitted by law, our total liability for any claim will not
exceed the amount you paid for the product or order giving rise to the claim.
24. Indemnification
You agree to defend, indemnify, and hold harmless Flora-Bama and its owners, officers, employees,
affiliates, vendors, service providers, and licensors from and against claims, damages, liabilities,
losses, costs, and expenses arising from your misuse of the website, violation of these Terms, violation
of law, unauthorized use of intellectual property, or User Content you submit.
25. Force Majeure
We are not responsible for delay or failure to perform due to events beyond our reasonable control,
including weather, hurricanes, natural disasters, fire, flood, labor shortages, carrier delays, supply chain
disruptions, cyber incidents, utility failures, acts of government, public health emergencies, war,
terrorism, civil unrest, or other events beyond our control.
26. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law
principles. Subject to the arbitration provision below if adopted, any court proceeding shall be brought in
the state or federal courts located in Florida, and you consent to jurisdiction and venue in those courts.
27. Optional Arbitration Provision
Any dispute, claim, or controversy arising out of or relating to these Terms, the website, or a purchase
from Flora-Bama Store shall be resolved by binding individual arbitration, rather than in court, except
that either party may bring an individual claim in small claims court or seek injunctive relief for
intellectual property misuse. The arbitrator shall have authority to award the same individual relief a
court could award. Class actions, class arbitrations, private attorney general actions, and representative
proceedings are not permitted unless applicable law requires otherwise.
28. Changes to These Terms
We may update these Terms at any time by posting a revised version on the website. The updated
Terms are effective when posted unless a later effective date is stated. Continued use of the website or
purchase of products after changes are posted constitutes acceptance of the updated Terms.
29. Severability and No Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to
the fullest extent permitted by law. Our failure to enforce a provision is not a waiver of our right to
enforce it later.
